USA, Israel, and the ICC/ICJ

Congress invited Netanyahu to speak at Its Join Session!

Is U.S. Becoming a Vassal State of Israel[1] ?

I had barely finished my latest writing for the blog when several new and relevant events took place, and I had to incorporate them into the original articles. I can’t be more amazed of what I am witnessing in my adopted country. What is happening here? Have we completely lost our minds? Are we still consider to be subscribed to a shred of humanity? What went wrong with us and when did it happen? Are we cheriching the legacy of the homeland of Washington, Jefferson, Franklin, and those great souls who fought the most incredible power on earth and got rid of it by embracing freedom, peace, and equality for all?

Twelve of our senators have written a letter to the head prosecutor of the International Criminal Court, threatening him with reprisal for his action against a man who, in the eyes of the world, has and is committing crimes against humanity, the fascist Prime Minister of Israel, Mr. Netanyahu.

Tom Cotton, Mitch McConnell, Marsha Blackburn, Katie Boyd Britt, Ted Budd, Kevin Cramer, Ted Cruz, Bill Hagerty, Pete Pickets, Marco Rubio, Rick Scott, and Tim Scott. This group again showed the world their shallowness and inability to understand the depth of their power and its limitations. Shouldn’t there be a system to oversee the senators’ irresponsible and childish behaviors? Is our arrogance surpassed our intelligence to measure our power by what we can or cannot do? How did they reach where they are with their compromised intellectual ability?

Netanyahu pursuing the Nazism. charter, bombed and burned down a refugee camp in Rafah, causing the death of 45 and injuring over 200. He stated that it was a “tragic mistake.” Mr. Prime Minister, based on your performances it is very hard for the world to believe what you have stated. It will not be far afield if no one believes you.

BBC on 5.29.24 REPORTS:

“The White House believes Israel’s military operations in Rafah do not fall afoul of President Joe Biden’s condition to supply weapons…Spokesman John Kirby has said.”

What a disgrace to humanity.

CNN reported the very exact statement on the same day that our president stated:

“Israelis did not cross the line, and therefore, he will be doing nothing.” What a shame that we must tolerate from our administration, showing the world its servitude to their MASTERS. I am ashamed of what my government is doing; it supplied the munitions used by the Israeli to kill innocent people.

CNN (May 29, 24) reported that Nikki Haley, in her most recent trip to Israel was noted to write on an Israel bomb  destined for Palestinians “Finish them.” The message on the shell was photographed and celebrated by Israel former UN Ambassador Danny Danon. It read “Finish them! America [Heart] Israel always, Nikki Haley”

How can one define her action:  a servant of Israel, an employee of Netanyahu, a traitor to our system and our country? I don’t know, you be the judge.

                                                                     ************

I am in receipt of the latest news that Mr. Netanyahu has accepted the invitation of our Congress (Democratic and Republican leaders),  to speak at its join Session. This will be his fourth talk to the Congress (Jewish insider, June 2, 2024).  I am ashamed of what our congress has done and I remember vividly his last talk in 2015 badmouthing our President Mr. Obama in our congress to the delight of those who had invited him(Congressman John Boehner, Speaker of the House). ARE OUR ELECTED OFFICIALS MAKING  OUR COUNTRY A VASSAL STATE OF ISRAEL?

The past few weeks were an exceptional period when the world witnessed some extraordinary events not usually entertaining us. Iranian president, Ibrahim Raisi was killed in a helicopter accident; the International Criminal Court issued a warrant for the arrest of the Israeli Prime Minister, Mr. Netanyahu, and one of his ministers, as well as three of the Hamas’ leaders. The  ICJ (International Court of Justice) issued a notice instructing Israelis to stop further war efforts in Rafah. Each of these incidents may present  an important step on the future of the Middle East.

The exact cause of the helicopter crash resulting in the death of the Iranian President is not known and may never be found.  It may be genuinely due to a malfunction or an accident or be the result of a sabotage. In either case the question is who the perpetrators were: internal saboteurs or external agents. If it was from within, was it an action taken by Khamenei to get rid of a rival? Or was it the doing of an opposition group?

If it was caused by actions of a foreign power, which could be the most likely? Off hand, Israel is the most capable party, either alone or with in conjunction with the Americans and possibly the British. Israel demonstrated exceptional aptitude in these types of actions. Overall, I wish this incident would never happen. I would have loved to see him alive, in a Court of law, facing the charges of the crimes that he had committed and the massacre that he had done in his country. What happened was an easy way out for him.

However, I place a much higher value on the decisions handed by the two international courts, the ICJ and ICC, both against Israel and crimes that its government is committing against a part of the helpless citizens. That, almost reiterates what I have so often explained in my writings, “Israel is committing the crime of genocide against the Palestinians.” Mr. Netanyahu’s Likud party is like Hitler’s Nazi Party. I have also explained that irrespective of the decision of ICJ, Israel, in the world’s view, will be considered the loser. The world was unaware of the Germans crime of genocide until the end of the WWII, but todays’ scientific progress made possible for all to witness the criminal actions of the Israel hardliners.

I am saddened and deeply concerned witnessing  the unconditional support of the United States for Israel, with the knowledge that they are supporting a government involved in illegal international criminal acts. Mr. Biden calls the ICJ judgment “Atrocious.” Why is it atrocious, Mr. President? Don’t you believe that they are committing genocide? Then why are you making efforts to send food to the victims by creating artificial ports? Or it is because you don’t know what you are doing or playing politics with the lives of innocents?

Another bothersome fact confronting me is what some of my fellow Iranians, supposedly loyal to Prince Reza, are committing. They are posting notes and despicable photos of what is going on. They are pushing Mr. Netanyahu and Trump’s agenda and presenting them as the savior of Iran! Their action could be interpreted on their minuscule knowledge of what is going on around them. They are badmouthing the present President of the U.S. and whoever, in their compromised level of general understanding, fits into scope of their action. What they are  doing can be detrimental to the future of Prince Reza. I don’t know who in the Prince’s organization is overseeing the action of his followers. Are these people for the Royalty, or are they serving the interest of a third party? I shall, in my future writings, elaborate on this subject in a more detail.

Back to our main agenda, on Friday, May 24, 2024, the ICJ (International Court of Justiucce) ordered Israel to stop the war in Rafah, the southern city of Gaza. An order that everyone believes Israel will not comply with. The South African government’s complaint of genocide committed by Israel in Gaza was at the core of this decision. The court accepted the request since both countries are signatories to the articles on genocide.

I am going to sidestep here and familiarize the readers with the essential elements governing these two international court systems. You can read the complete details on the websites of those two organizations.

The ICJ (International Court of Justice) was established after WWII to address the problems between the States and is a part of the United Nations. However, the ICC (International Criminal Court) was established in 2002 to prosecute individuals who commits  atrocious crimes against humanity, genocide, and crimes of aggression.

The ICC statute was adopted on July 17, 1998, by the United Nations Diplomatic Conference of Plenipotentiaries on the establishment of an International Criminal Court. By its article 125, the statute was opened for signature by all States in Rome at the Ministry of Foreign Affairs of Italy at the headquarters of the Food and Agriculture Organization of the United Nations until July 17, 1998. The establishment became functional in 2002. The laws delineating its function are comprised of 125 articles. ICC addresses four categories of crimes: Genocide, Crimes Against Humanity, War Crimes, and Crimes of Aggression. These are discussed in detail in articles six, seven, eight, and eight bis4.

Article Six: Genocide: It is described in the following way:

  (a)  Killing members of a group:

  (b)  Causing serious bodily or mental harm to members of the group:

              (c) Deliberately inflicting on the group conditions of life calculated to bring about its                physical destruction in whole or in part:

(d)  Imposing measures intended to prevent births within the group:

(e)  Forcibly transferring children from one group to another group.

Article 7

Crimes against humanity

Any of the following can be categorized as a crime against humanity:

(a)  Murder.

(b)  Extermination.

(c)  Enslavement.

(d)  Deportation or forcible transfer of population.

 Article 8

War Crimes

Grave breaches of the Geneva Conventions of August 12, 1949, namely, any of the following acts against persons or property protected under the provisions of the relevant Geneva Conventions:

(i)  Willful killing:

(ii)  Torture or inhuman treatment, including biological experiments:

(iii)  Willfully causing great suffering or serious injury to body or health:

(iv)  Extensive destruction and appropriation of property, not justified by military necessity and carried out unlawfully and wantonly:

            (v)  Compelling a prisoner of war or other protected person to serve in the forces of a hostile Power

Article 8 bis4:

Crime of Aggression:

Act of aggression means the use of armed force by a State against the sovereignty, territorial integrity or political independence of another State, or in any other manner inconsistent with the Charter of the United nations. The main issues here are the followings:

  1. The invasion or attack by armed forces of a State of the territory of another State:
  2. Bombardment by the armed forces of a State against territory of another State:
  3. Blockade of the ports or coasts of a State by the armed forces of another State:
  4.  An attack by the armed forces of a State on the land, sea, or air forces or marine and air fleets of another State.

The South Africans are aware of the demonoid actions of the Apartheid system. They suffered under those ideologies for decades. For years, their efforts for freedom were hampered by the opposition of the Western governments: Israel, the United States, Britain, etc. Their past gave them the power to recognize the signs of apartheid when one is present. They found it in the conflict between Israel and Palestine. Our ex-president, Mr. Jimmy Carter, in his book: “Palestine: Peace, not Apartheid” clearly indicates his concerns that Israelis are hampering the peace process by occupying Palestinians’ land and creating unlawful settlements for their citizens. In my numerous writings, I have alluded to these problems in detail.

In one of my recent articles, I explained that irrespective of the outcome of the ICJ, Israel will be the loser. Now, the verdict is in. Screams of Mr. Netanyahu and his cronies in the U.S. can’t help exonerating him from the crimes that he has committed.

What the South African government has initiated has been followed by a group of nations critical of the path taken by U.S. and the Westerners. Many experts agree that the global south is critical of the lack of pressure of Westerners over Israel for massacring innocent people to compensate what Hamas has done on last October. Many of the non-western nations oppose the war in Gaza. China called for a cease-fire. Several Latin American governments severed their relations with Israel.

Global South in RED and Global North in Blue

On the Western front, the people’s opinion is shifting away from their governments. Israel is losing popular support among Europeans; even with the governments still, and at least on the surface, remaining friendly with them. Israel can bet on British backing since they were the primary creators of the state. The Americans will support Israel because most of the political machineries in U.S. are under the control of the Israelis. The Germans are bending backward to the point of breaking their spine in supporting Israel. They are trying hard to compensate for the crimes that they committed against the Jewish people in the 1930s and 1940s. I see nothing genuine about their action. Germany is siding with Israel in the ICJ, and nations like Bangladesh and Namibians are supporting the Palestinians. Hugh Lovatt, a senior policy fellow at the European Council on Foreign Relations, said the geopolitical divide between the Global South and the West is deepening, and accordingly, he believes that the Germans “are not fully atoned with the killings.”

On May 20, 2024, Karim Khan (Scottish  judge), prosecutor of ICC, announced that he was issuing a warrant for the arrest of Mr. Netanyahu, his defense minister Yoav Gallant, and three of the leaders of Hamas: Yahya Sinwar, Mohammad Diab Ibrahim al-Marsi, and Ismail Haniyeh for crimes against humanity and War crimes. His action received approval of every nation around the globe, if not necessary of their governments.

Mr. Khan’s statement created a commotion of great magnitude all over the world, especially in the United States, Britain, France, and the pseudo-friend of Israel, Germany. The Israeli organizations in the U.S. reacted to the ICJ and ICC decision in the expected ways. Considering their writings, it seems that they have forgotten that most nations are not against the existence of Israel. The objections are in their hardliner’s behavior, their irrational action against the civilians in Palestine, their lack of adherence to international laws, their ignoring the facts that the world populace is getting tired of their greed in grabbing Palestinian lands and incorporating them into Israel and leaving thousands of people including women, and children, without a home and depriving them of the livelihood of a decent life, and constantly crying wolf “ANTISEMETISM.”

In an interview with CNN’s Christiane Amanpour,” Khan said a senior U.S. elected official even told him that the ICC “was built for Africa” and for “thugs like [Russian President Vladimir Putin]” but not Western or Western-backed leaders.”

U.S. President, Mr. Joe Biden criticized Khan’s decision by calling the indictments against Israeli leaders “outrageous.” As an individual the President is free to state his mind. However, I am not sure that many of the Americans agree with him. Shall we be expecting the dispatch of the American sixth fleet to the shores of the Netherlands as a token of support for Israel?

Significant Differences Between the Two Legal International Courts.

My personal study of the American politicians over the past several decades leads me to believe that I can easily accept Mr. Khan’s statement to be true. He continued that “The court is the legacy of World War II, and this court is a sad indictment of humanity, and this court should be the triumph of law over power and brute

The judges at ICC violated the sacred, unwritten laws of the U.S., and by their action they  insulted the Israelis, the sacred cows of the American government, like the holy cows of the Egyptian mythology,   (Hothor, Hesat, Apis, and Mnenvis.). We must wait and see what will be coming up in the days ahead.

Are we going to witness the U.S. Government in a gesture of friendship with Israel will start sanction against the members of the ICC and ICJ Courts? Why Not? “Anything to please Israelis.” Dispatching our sixth fleet and sanctioning those opposing us became standard procedure for our government to solve the world problems.

We, as the Americans are acting exactly like ostriches. We submerge our head into the sands and avoid seeing what is going on around us and expect that no one will be able to see us. We are one of the most uninformed nations in the world. We are fed a bunch of nonsense by those ruling over us. We can justifiably be named, “The Nation of Sheep.”

Apis, the sacred cow of the Egyptian mythology

I have no doubt most of the Israelis do not approve what their government is doing. There is  very little doubt that their present regime cannot last long as a functioning democracy, while pursuing the current method of governing. The people of Jewish faith must accept that there is a difference between a religion and a state, and the affairs of the two cannot be mixed. Long ago I wrote about this subject and was bitterly opposed by a friend who thought differently. I am a firm believer that the sooner the Israelis accept that fact the better will be their chances to be accepted internationally. I shall elaborate again on this subject in my future writings.

[1] – The ideology probably started with Lord Curzon who in the early twentieth century subscribed the idea “we buy foreign dignitaries and by doing so we gain a friend and with their help we make their country a vassal state of Britain, exactly what Israeli hardliners are doing with the U.S.

  1. Is there a conflict/war any where in the world, which since the end of WW2. that hasn’t involved America and it’s arms industry?

  2. Dear Dr. Guilak,

    Thank you for your article.

You asked what happened to America and when it happened?

I migrated to the U.S. in 1970 and watched the corruption work its way after the WWII to the core of American political power system.

Looking back, it should have been obvious that it happened with rebellion over the parent country, in effect, shamelessly waxing proud against the fatherland, British Empire and siding with sworn enemies and wiping out many native nations to make America!

If this beginning was missed, then San Jacinto war, where Sam Houston mounted a cowardly raid, against all international rules of war, should have marked that start.

If that was missed, much more recent drop of nuclear bombs on Japanese cities of Hiroshima and Nakasaki, populated by only women, children and elderly should not have been missed.

Fast forward to American atrocities of Korean war, Vietnam war’s carpet bombing and agent orange or Iraq, Afghanistan, Syria or Libya. Or south American invasions and manipulations.

This pattern has precedence in other barbaric nomads rise to power. Never in countries with national and cultural histories like Egypt, China, Persia or India. Arabs, Mongols, Nazzis, Americans and now Israelis who invaded other nations to form a new renegade nation all followed the same path of rise to power and ultimate destruction.

This nation has already destroyed itself. The rest is the final struggle to surrender to self annihilation. I realized this fact over a decade ago when I migrated for second time out of U.S.A.

The answer may be that a netion born with a criminal gene will die with that gene as a proof of live by a sword, die by a sword!

I often wish I were wrong but each passing day brings forward another sad proof!
